Kota Kinabalu: Mahkamah Sesyen Kota Kinabalu hari ini menolak permohonan Ketua Polis Negara serta 3 pegawai kanan polis untuk membatalkan saman ke atas mereka dan 3 defendan lagi di atas dakwaan melakukan kecuaian dan konspirasi tort secara salah dengan niat menyebabkan kerugian dengan cara penipuan atau menyalahi undang-undang ke atas plaintiff Michael Ingkian tujuh tahun lalu.

Mahkamah membuat keputusan itu selepas membaca keterangan afidavit dan mendengar hujahan daripada peguam Plaintif Mohd Azhier Farhan Arisin dan Peguam Persekutuan Dorine Patrick daripada Jabatan Peguam Negara.

KOTA KINABALU: A government pensioner had successfully brought claims for breach of contract, nuisance and trespass against a prominent local business man in Kinarut, Papar.

The Plaintiff -- Halimah Osman -- who was represented by Counsel Mohd Azhier Farhan bin Arisin had initiated legal action in the Sessions Court at Kota Kinabalu for recovery possession of a land and damages for breach of tenancy agreement, nuisance and trespass against Frederick Chin Chit Vun and was awarded damages by the Sessions Court amounting to RM 60,000.00 plus statutory interest of 5% per annum.

Kota Kinabalu: Two locals and four Filipinos, charged with having 1,308 turtles illegally, will get to know their fate on April 27. 

Sessions Court Judge Ainul Sharin Mohamad set the date for Rashed Delan, 38, Alsadat Belog, 39, and Filipinos Madal Juldin, 37, Ibrahim Kahal, 44, Sidik Napaeh, 23, and Rasid Alain, 38, when the defence closed its case after calling seven witnesses on Wednesday.

Jailed, fined for having imitation pistol component

KOTA KINABALU: A 26-year-old man, who was caught at the airport here for having an imitation pistol component, was jailed seven days and fined RM5,000 or six months' jail. 

Magistrate Stephanie Sherron Abbie ordered hotel worker Hiew Mick Foh, who had been under remand for seven days, to serve the jail term from the date of his arrest.

Six charged with illegal possession of turtles defended by Counsel Azhier Farhan

 

The Sessions Court here yesterday allowed RM10,000 bail for a Filipino who was jointly charged with five men with possessing 1,308 turtles illegally last year.

Judge Ainul Shahrin Mohamed made the decision on IMM13 holder Ibrahim Kahal, 44, at the request of his counsel when the case came up for case management yesterday.

Ibrahim was jointly charged together with Rashed Delan, Alsadat Belog, Madal Juldin, Sidik Napaeh and Rasid Alain under Section 41(2) of the Wildlife Conservation Enactment 1997, punishable under Section 41(4) of the same Enactment and read together under Section 34 of the Penal Code.

KOTA KINABALU: A 34 years old local Dusun man escaped life imprisonment after the Sessions Court acquitted and discharged him of drugs possession.

Sessions Court Judge Ainul Shahrin Mohamad made the decision on Elton George Junior Gaban after finding that the prosecution had failed to prove a prima facie case against him under section 39A(2) of the Dangerous Drugs Act 1952.

Cashier discharged from online purchase fraud

KOTA KINABALU: A 21-year-old cashier was discharged from a cheating charge over an online purchase of a laptop. Magistrate Jessica Ombou Kakayun made the order on Hasimah Jideh when the case was heard in her chamber.

According to Hasimah’s counsel, Azhier Farhan Arisin, the victim has retracted her report after realising it was just a misunderstanding.

Duo charged with trafficking 5,008gm of syabu

KOTA KINABALU: Two men were jointly charged with trafficking in 5,008gm of syabu. However no plea was taken from Andy Lim Shau Seng, 31 and Yei Yung Chin, 35 who were brought before Magistrate Stephanie Sherron Abbie. They allegedly trafficked the drugs in front of Kedai Yuen, Jalan Gaya at about 4.15pm on Aug 29 recently. The offence framed under Section 39B (1)(a) of the Dangerous Drugs Act 1952, provides for the mandatory death penalty.

2 pegawai Bank didakwa rasuah

KOTA KINABALU - Dua pegawai bank mengaku tidak bersalah di Mahkamah Sesyen di sini atas tuduhan menerima rasuah RM7,000 daripada seorang individu, awal September lepas. Muhammad Safwan Isnen, 27, dan Azzry Eyzzamshah Mohamad Arifin, 27, dituduh secara bersama menerima wang suapan berkenaan daripada Afizi Ahmad, di restoran Starbucks Coffee, berbelahan pintu utama One Borneo Hypermall pada 10.13 malam, 6 September.

Salesman fined RM2,500 for showing porn to children

A clothing salesman who showed a pornpgraphic video to two children was fined RM2,500 in default three months' jail by the magistrate's court here, Tuesday.

Magistrate Zuhair Rosli imposed the fine on David Ng Qi Long, 22, after he pleaded guilty to showing the video on a mobile phone to his neighbour's children, a girl aged 10, and a boy aged 11, with the intention of insulting their modesty.

7 Bank Rakyat officers in Sabah arrested for graft

KOTA KINABALU: Graftbusters have swooped in to arrest seven Bank Rakyat officers who demanded kickbacks and used falsified documents to enable a civil servant to get a loan from the financial institution. Sabah Malaysian Anti-Corruption Commission (MACC) chief Datuk Shaharom Nizam Abd Manap said in a statement on Thursday that the seven officers were arrested together with a self employed man on Sept 6 and 7.

Man charged with causing grievous hurt to sister

A 42-year-old construction supervisor was charged at the Magistrate's Court here Wednesday with causing grievous hurt to his sister. Hamdan Asnan pleaded not guilty to committing the offence on one Asnih Asnan, 33, at 8am on June 19 in a house at Kg Cenderakasih near here. The offence under Section 325 of the Penal Code carries a jail term of up to seven years and liability of a fine on conviction. Magistrate Jessica Ombou Kakayun set Aug 17 for case management and released Hamdan on an extended bail.

A 40-year-old woman soldier who caused hurt to a policeman to deter him from his work during a roadblock was placed on a good behaviour bond for two years. Juhaneh Jahampung admitted before Magistrate Jessica Ombou Kakayun to committing the offence on one Lance Corporal Tommy Runggan at 1.15am on April 20 along Jalan Tun Fuad Stephens here. Earlier, counsel Azhier Farhan, representing Juhaneh, applied for a bond of good behaviour saying that Juhaneh, who is single, was a first offender and taking care of her mother who was suffering from leukaemia.

KOTA KINABALU: Bersih Sabah chairperson Jannie Lasimbang, who claimed trial in October last year to charges under the Peace Assembly Act 2012, will stand trial on February 25–26 this year. Magistrate Cindy Mc Juce Balitus maintained the trial dates for Jannie, 53, when the case came up for case management.

On the first and second charges, Jannie, who is also a former Suhakam commissioner, is alleged to have organized an assembly at Taman Awam Teluk Likas at Tanjung Lipat here from about 2pm to 9.30pm on Aug 29, 2015 and from 10am to 12pm on Aug 30, without notifying the officer in charge of a police district, Kota Kinabalu (OCPD KK) ACP Chandrasehkaran Muthu, 10 days before the date of the assembly. Deputy public prosecutor Gan Peng Kun prosecuted and Ram was assisted by counsel YS Lo, Timothy Daut, Luke Ressa Balang and Azhier Farhan Arisin.
